Dumped trolleys

Marion Council has introduced a new by-law that aims to keep our streets free from shopping trolleys.

Abandoned trolleys are a safety hazard, blocking footpaths around shopping centres. They are also an eyesore, dumped in parks and waterways.

This is the first by-law of its type in South Australia.

From 1 February 2021, Marion Council will begin to enforce our new Shopping Trolley Amenity By-law.

Shopping trolleys must not be removed from the grounds of any shopping centres or supermarkets within the City of Marion.

If someone removes a trolley, Council’s authorised officers can issue a direction to return the trolley. A fine of $187.50 can be issued if a person does not comply with the direction and the trolley is not returned.

Retailers must take steps to prevent shopping trolleys from leaving their shopping precinct.

There are three types of retail categories:

1. A retailer who has 25* trolleys or more and has a trolley containment system.
   
   If a trolley is discovered out of their retail precinct, they can be directed by Council’s authorised officer to remove it. A fine of $187.50 can be issued if the retailer fails to remove it within 72 hours.
   
2. A retailer who has 25* trolleys or more and does not have a trolley containment system.
   
   If a trolley is found outside their retail precinct, they can be issued with a fine of $187.50. An additional fine of $187.50 can apply if the retailer fails to remove the shopping trolley within 72 hours when directed by Council’s authorised officer.
   
3. A retailer who has less than 25* trolleys.
   
   If a trolley is found out of their retail precinct, a Council authorised officer can direct them to remove the trolley within 72 hours. A fine of $187.50 can be issued if the retailer fails to remove it within that time period.

We want to keep the community safe and our city attractive.

*Council will be considering increasing this number to 30 at its General Council Meeting in January 2021.

The changes to shopping trolleys laws are the result of a community campaign led by Marion Council.

After consultation, Council endorsed a by-law to deal with shopping trolleys abandoned in the community. The by-law came into effect on 2 November 2020 but the enforcement provisions of the by-law begin on 1 February 2021, unless the by-law is disallowed by State Parliament.
